This contract constitutes a binding agreement between the Client and Tupac Adventures® (hereinafter referred to as “the Agency”), a fully licensed tour operator registered under Corp. Tupac E.I.R.L. By confirming a booking and paying the deposit, the Client agrees to be fully bound by the terms outlined herein. This contract is legally enforceable and covers all aspects of the booking, including deposits, payments, cancellations, and liabilities. If the Client does not agree with any of these terms, they should refrain from making a reservation. The contract becomes effective only upon receipt of the deposit.
The Client is responsible for providing accurate and complete personal information, including full name, passport number, nationality, and emergency contact details at the time of booking. This information is required for booking and permits. Failure to provide accurate information may result in delayed processing or denial of participation. It is also the Client’s responsibility to ensure all documentation is valid, such as passport validity (at least six months from entry into Peru). The Agency is not responsible for any travel complications arising from incorrect or incomplete data provided by the Client.
In the event that the Client wishes to change their reservation, they must notify the Agency at least 48 hours before the scheduled tour or trek. The Agency will accommodate changes based on availability and may apply additional fees. Changes to itineraries or dates may not be possible due to the fixed nature of permits.
Si un cliente no puede viajar dentro de los 20 días, el dinero se transferirá a otra persona adecuada para su reserva o menos del 35% del pago.
Cancellations by the Client must be received in writing. The deposit is non-refundable under any circumstances. For tours and treks canceled by the Client, no refund will be issued for the deposit. However, in the case of multi-day itineraries, if the Client cancels with at least 30 days’ notice, a refund of 50% of the deposit may be considered. Cancellations less than 30 days before departure are not eligible for a refund.
The Client is strongly encouraged to purchase comprehensive travel insurance to cover cancellation, medical emergencies, and potential interruptions. The Agency is not liable for costs arising from cancellations, injuries, or other incidents. The insurance should cover the Client’s personal belongings, health, and emergency evacuation costs.

The Client can trust that all financial transactions are handled with the utmost care, in accordance with Peruvian legal and financial standards.
The Agency is committed to delivering high-quality tours and ensuring that the services offered meet the Client’s expectations. However, the Agency is not responsible for any disruptions to the tour caused by external factors such as natural disasters, political instability, or other events beyond its control. The Agency will make reasonable efforts to minimize any disruption and offer alternatives if necessary. The Agency is also not responsible for any travel delays or missed connections caused by external transportation providers.
The Agency’s tours are generally designed for adult participants aged 12 and over. However, families with younger children may request participation on certain tours with prior approval from the Agency. The Ultra Tours or Active Tours are physically challenging hiking experiences, designed to gradually acclimatize participants to the high altitudes of the Andean region while also enhancing their endurance. These tours are structured to allow progressive adaptation to the altitude, helping participants avoid the adverse effects of altitude sickness while improving their physical performance under extreme conditions. As participants progress along the routes, they are provided with a controlled level of intense exercise, optimizing their acclimatization while building their stamina.
The Ultra Machu Picchu Tour is specifically designed for the Ultra Machu Picchu Ultramarathon, a renowned sporting event in which Tupac Adventures® is a commercial partner. This tour is geared toward runners and adventurers participating in the competition, offering them practical training for the race while enjoying the stunning landscapes of one of the most iconic routes in the world. The Agency provides an appropriate training environment for athletes, giving them the opportunity to acclimatize to the altitude and increase their endurance before the competition. It is important to note that the Ultra Machu Picchu Tour is specifically designed for those participating in the ultramarathon, ensuring that they are fully prepared for the challenges of this unique event.
The reservation process is initiated upon payment of the required deposit, which secures your spot and the necessary permits for the tour. The Client acknowledges that without the deposit, the reservation is not confirmed, and permits will not be purchased. Deposits are non-refundable and non-transferable, as they ensure the acquisition of permits through the Peruvian government. The Agency recommends that the Client make the deposit as early as possible to avoid missing out on high-demand dates or tours, as availability is limited.
- Trekking Tours: A deposit of USD $300 per participant is required for trekking tours, including popular treks such as the Inca Trail, Salkantay, Lares, and other trekking options. This amount is essential for the purchase of permits and guarantees the spot in the tour.
- Multi-Day Itineraries: For multi-day itineraries that do not focus primarily on trekking, a deposit of 50% of the total trip cost is required. This deposit ensures the reservation of accommodations, transport, and other essential services. The remaining balance is due before the trip departs. Failure to pay the final balance before the specified date may result in the cancellation of the booking, and the deposit will not be refunded.
- Day Tours: For day tours, full payment of 100% of the total price is required at the time of booking. This is because the tours are one-day experiences, and the full payment ensures the reservation of services such as transportation, guides, and entry fees. The payment must be made in full and confirmed before the day of the tour.
The Agency reserves the right to modify the itinerary in the event of unforeseen circumstances such as extreme weather, road closures, or government restrictions. Clients will be informed promptly of any changes. While the Agency strives to offer the best possible service, some changes to the original plan may be inevitable.
Any complaints regarding the service should be submitted to the Agency within 7 days after completing the tour. The Agency will address complaints promptly and make reasonable efforts to resolve the issue. Complaints received after the 7-day period may not be considered unless there are exceptional circumstances.
The Client must complete a medical form before the trek, outlining any existing medical conditions that may affect their participation. This information is critical for ensuring the Client’s safety during physically demanding activities. Failure to disclose medical conditions may result in the Client being unable to participate in the trek or tour.
The Client is responsible for adhering to all safety and health instructions provided by the Agency’s guides during the tour. The Client must follow the rules and regulations outlined at the start of the trip, including respecting the environment, other participants, and the local communities. The Client must ensure they have all required travel documents, including a valid passport, visa, and travel insurance. The Agency is not liable for any personal injury, damage, or loss resulting from the Client’s failure to comply with the guidelines.
Clients are advised to arrange their flights to arrive in Cusco at least one day prior to the tour’s start date to avoid any issues due to flight delays or cancellations. The Agency is not responsible for any costs related to flight delays, cancellations, or missed connections. It is strongly recommended that Clients purchase flexible tickets to accommodate changes that may arise during the tour.
Last-minute bookings made less than 48 hours before the tour departure must be confirmed immediately. Due to the time-sensitive nature of securing permits and other logistics, the Agency cannot guarantee availability for late reservations. Last-minute bookings may be subject to additional fees, and Clients should be aware that changes to the itinerary or booking details may not be possible with such short notice.
